Power of Attorney

When you are of firm mind as Granter you can legally appoint Attorneys to make decisions on your finances and / or welfare should you be unable to do so.

For example; difficulty in managing / accessing assets which are in joint of individual names

Without a POA Social Services may well decide on your welfare rather than your own family

NO! Accidents, or Illness have no age restrictions, prevention is better than cure.

If you lose capacity it’s too late to put a POA in place.

You can appoint who you want, spouse, partner, children, relative, solicitor or accountant.

The most important point is that you TRUST them. It’s always prudent to have additional or substitute Attorneys just in case your appointed Attorney is unable to act.

Yes, they can help you with your finances or business if you want them to do so, or for convenience. However they cannot make decisions about your welfare until you are no longer able to make those decisions for yourself. POAs provided by Will Planning Consultants can give you extra control as to when the Attorney can act.

YES, a POA is not valid until it has been registered. Will Planning Consultants do this for all clients.

Prior to this a POA document has to be certified by a Doctor, Solicitor or Legal Advocate to confirm the Granter has capacity at the time of signing.

Our solicitor shall certify clients POA at our office or in the comfort and privacy of your home if preferred as part of our service

It’s important your POA is kept up to date with changes to Granter of Attorney’s address or name details. (such as a daughter getting married) Will Planning Consultants normally advise the OPG on our clients behalf.

However it is not possible to change Attorney’s. In such cases the Granter must have capacity to revoke their existing POA and put a new POA in place, both documents require to be certified by our Solicitor pnrior to registration with the OPG
